Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CastVerb application for macOS and the website at castverb.com (collectively, the "Service"), operated by CASTWORD LLC ("CastVerb", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. You must authenticate via a supported identity provider (currently Google). You are responsible for maintaining the security of the account you use to sign in.

The Service offers a free Basic tier and a paid Pro tier. Tier features and prices are described in the app and on our website and may change with notice.

Paid subscriptions auto-renew unless cancelled before the next billing cycle. Cancellations take effect at the end of the current billing period; no partial refunds for unused time, except where required by law.

EU and UK consumers: you have a statutory 14-day right of withdrawal for distance purchases of digital services. By starting to use a paid feature during checkout, you expressly consent to immediate performance of the contract and acknowledge that you lose the right of withdrawal once the service has been fully performed (e.g. once a redemption code is consumed or once you begin using paid features). For undisclosed cases, contact support@castverb.com within 14 days of purchase for a full refund of unused service.

5. Redemption codes

Codes issued by CastVerb grant the stated tier for the stated duration when redeemed. Codes are single-use, may have expiration dates, and may be revoked if obtained or used in violation of these Terms.

6. Third-party providers

The Service routes voice audio to third-party transcription and AI providers selected by you or by CastVerb's managed Pro key pool. Your use of those providers is also governed by their terms; CastVerb is not responsible for the availability, accuracy, or actions of third-party providers.

7. Intellectual property

The Service, including all software, design, and content provided by CastVerb, is owned by CASTWORD LLC and is licensed, not sold, to you under these Terms. You retain ownership of the text you dictate, the commands you issue, and any feedback you submit.

By submitting feedback (including posts, replies, votes, and comments) to the Service, you grant CastVerb a worldwide, non-exclusive, royalty-free license to display, reproduce, and use that feedback to operate and improve the Service.

8. Termination

You may stop using the Service at any time and delete your account from in-app Settings. We may suspend or terminate your access if you breach these Terms or if continued service would expose us to legal or operational risk. Sections that by their nature should survive termination (including Sections 7, 9, 10, 11) will survive.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRANSCRIPTION OR ACTION EXECUTION WILL BE ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTWORD LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $50.

You agree to indemnify and hold CASTWORD LLC harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Service.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Where required by local law, EU/UK consumers retain mandatory rights under their local jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app and on this page. Continued use of the Service after a change constitutes acceptance of the updated Terms.

14. DMCA and content takedowns

Community feedback (posts, replies, votes) hosted on the Service may contain user-submitted content. If you believe content posted on the Service infringes your copyright, send a written notice that meets the requirements of 17 U.S.C. ยง 512(c)(3) to our designated agent:

Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material to be removed and its location on the Service; (d) your contact information; (e) a statement made under penalty of perjury that you have a good-faith belief that the use is not authorised; and (f) a statement that the information in the notice is accurate. We will respond to properly submitted notices and may terminate the accounts of repeat infringers.
